1. Acceptance of Terms

If you do not agree to these Terms, you should not use the Website or procure services from us. These Terms, together with our Privacy Policy, form the full agreement between you and us, superseding any prior or contemporaneous agreements, communications, or proposals.

2. Services

We provide mold inspection, mold removal, water damage restoration, fire damage repair, air duct cleaning, anti-bacterial cleaning, and related services (collectively, “Services”). All services are subject to availability and our acceptance. We reserve the right to refuse or cancel any order or request at our discretion.

3. User Obligations

When using the Website or requesting services, you agree:

  • To provide accurate, current, and complete information
  • Not to impersonate any person or entity
  • Not to use the Website for unlawful or prohibited purposes
  • To comply with applicable laws
  • That any materials, images, or descriptions you provide (e.g. property photos) do not infringe third-party rights

4. Payment & Fees

  • You agree to pay all applicable fees for the Services you request.
  • Payment terms (e.g. upfront deposit, milestone payments, final payment) will be set in the individual service agreement or invoice.
  • Late payments may incur interest or fees, as allowed by law.
  • All fees are non-refundable unless otherwise expressly agreed in writing or required by law.

5. Scheduling & Access

  • You must provide access to the property or premises for inspection, removal, or restoration as scheduled.
  • Delays due to your inability to provide access may incur additional charges or rescheduling fees.
  • If you need to reschedule or cancel, you must notify us in advance, as per the cancellation policy outlined in the service agreement.

6. Disclaimers & Limitations

6.1. No Guarantee of Results
While we aim for high-quality performance, we do not guarantee that mold will never reappear, or that all spores will be eliminated. Environmental factors beyond our control may lead to regrowth.

6.2. Disclaimer of Warranties
To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

6.3. Limitation of Liability
In no event shall we (or our officers, employees, agents) be liable for any indirect, incidental, special, punitive, or consequential damages (including lost profits, loss of business, or property damage) arising out of or in connection with your use of the Website or our Services, whether in contract, tort, strict liability, or any other theory, even if advised of the possibility of such damages.

Our total liability to you for claims arising out of or relating to these Terms or the Services shall not exceed the amount you paid us for the specific service giving rise to the claim.

7. Indemnification

You agree to indemnify, defend, and hold harmless Long Island Mold Specialist and its officers, employees, agents, contractors, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms, misuse of the Website, or violation of rights of third parties.

8. Intellectual Property

  • All content on the Website (text, images, logos, graphics, designs, etc.) is owned by us or licensed to us, and is protected by copyright, trademark, and other intellectual property laws.
  • You may not reproduce, distribute, modify, publicly display, or create derivative works without our prior written permission.

9. Termination

  • We may suspend or terminate your access to the Website or services at any time, with or without cause or notice.
  • Upon termination, your rights to use the Website and our Services immediately cease, but any accrued obligations, disclaimers, and liabilities continue.

10. Governing Law & Dispute Resolution

  • These Terms shall be governed by and construed under the laws of the State of New York, without regard to conflict of law principles.
  • Any dispute arising out of or relating to these Terms or services shall be resolved through binding arbitration (or alternatively, in the courts of Woodbury, NY)—you and we each waive the right to a trial by jury and to participate in class actions (unless prohibited by applicable law).
  • Arbitration shall take place in Woodbury, NY, and be administered under the rules of the American Arbitration Association (or other mutually agreed provider).

11. Notices

All notices under these Terms must be in writing and delivered via email to longislandmoldexperts@gmail.com or postal mail to our official business address. Notices are effective upon receipt (for email) or three (3) days after mailing (for postal mail).

12. Severability & Waiver

  • If any provision of these Terms is found invalid or unenforceable, it will be struck and the remaining provisions will be enforced.
  • Our failure or delay to enforce any right or remedy under these Terms does not constitute a waiver of that or any other right or remedy.

13. Changes to Terms

We may revise or update these Terms at our discretion. If material changes are made, we will notify you (e.g. via email or prominent notice on the Website). Your continued use of the Website or services after changes means you accept the new Terms.
